Resumé

Involuntary inter prison transfer are for most prisoners very intrusive. Prisoners
adapt to prison life socially and psychological. Some participate in rehabilitation
programs and visits are planned and booked weeks ahead. Involuntary inter prison transfer are used by prison authorities for administrative and disciplinary
reasons such as prison capacity and maintaining order and security in the prison. Transfers may therefore be seen as a strategy for managing prisoners whose behavior is difficult or disruptive. In Denmark the official record shows in average 669 incidences of involuntary inter prison transfers for disciplinary reasons in the period 2006-2013. Involuntary transfers because of prison capacity are not registered statistic. A rule in Danish administrative law was implemented in 2002 and states that the prisoners can be involuntary transferred from one prison to the other without prior notice, statement of reasons or hearing and they are not allowed access to the documents in their case. In a legal protective perspective it is problematic that prisoners can be transferred without apparent reasons. This may cause a greater suspicion and distrust of the prison authorities and the society as such which can be seen as a barrier for successful offender rehabilitation.
